1 Privacy policy

This privacy policy complies with the General Data Privacy Regulation (GDPR) and applies to our app Splash smash.


1. About

We use only pseudonymous and non-persistent data. Once you delete the app, we cannot relate any data to you anymore. We ensure that our service providers process the data according to the GDPR and that they are certified by the EU-US Privacy Shield.


2. Terminology and definitions

GDPR: General Data Privacy Regulation
Advertise ID: The Advertising ID is a unique, random and resettable identifier that is located on your mobile device. On an Android Operationg System (OS), it is called the Google Advertising ID and on iOS, it is called the Identifier for Advertisers (IDFA).
Opt-Out:Opt-out is the option to either contradict the processing of certain data and to stop its further processing.
Instance ID: An app’s Instance ID is a unique identifier of that app. It is generated when the app is installed. If the app is reinstalled, a new instance ID is generated. Once a new Instance ID is generated, an assignment to the old app instance ID is not possible anymore. On iOS, it is also called the Identifier for Vendors (IDFV).
EU-US Privacy Shield: The EU-US Privacy Shield is an agreement between the European Union (EU), Switzerland and the United States of America (USA) that facilitates compliance with the GDPR in the USA. Further information can be found at https://www.privacyshield.gov/Program-Overview.


3. Ads within our app

We use advertising within the apps so that we can offer you the apps for free. For this, we will require your IP address to establish a connection to the advertising service provider. The advertising ID is sent to the advertising service provider for fraud prevention. The legal basis for processing this data is GDPR’s Article (Art.) 6 (1) literal (lit.) f, legitimate interests.
You can activate or deactivate personalised ads in our apps. By default, they are deactivated. If personalised ads are activated, we will show you ads that are of interest to you. The Advertising ID can be used to provide advertising according to either the demographic characteristics or previous interests. These characteristics and interests are collected and determined, for example, when you surf the web or use apps. You have to ensure that you are old enough to activate personalised ads. The age variies by country. If you don't know the minimum required age of your country to watch personalised ads, only activate them when you are at least 16 years old.
As an advertising service provider, we use Google AdMob. Google AdMob is a service of Google Ireland Limited (Ireland/EU), a subsidiary of Google Limited Liability Corporation (LLC) (Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States). 4. Remote push notifications

We use remote push notifications not only to improve the user experience but also for economic reasons. We can inform you about updates, use it as a reminder to play the game and similar. The legal basis for this is GDPR’s Art. 6 (1) lit. f (legitimate interests).
To send remote push notifications, we use the Google Firebase Cloud Messaging service. This service is provided by Google Ireland Limited (Ireland/EU), a subsidiary of Google LLC, based in the USA. The Instance ID is required to send push notifications and is shared with the Google Firebase cloud messaging service. Your data may be processed in the USA. In this case, Google is certified under the EU-US Privacy Shield.
Once you uninstall the app, the Instance ID cannot be assigned to you anymore, and no remote push notification can or will be sent to you.
You can deactivate the push notifications any time from the settings of the operating system of your mobile device or within our app.


5. Troubleshooting within the software

To reduce software errors within the app and increase the quality, an error report is sent to us when an error is detected. This error report contains the Instance ID. The app Instance ID is needed to know if the error still occurs on the devices after a bug fix update. Additional device information such as the operating system, version of the operating system, properties of the graphics card, etc. is also sent along with the information about the occurrence of the error. We do not collect any persistent identifier.
The legal basis for this is GDPR’s Art. 6 (1) lit. f (legitimate interests) to improve the quality of apps). The data will be anonymised by us after three months or will be anonymised once you delete the app.


6. Improving our app and content customisation through user analysis

If you use our app, we evaluate statistics concerning the apps themselves. In these statistics, we evaluate the selected "Themes", "Items", "game modes" and similar to know what is most popular among the users. This allows us to make adjustments to the designs and functions of the apps to match the general preferences of our users. These apps are not individually adapted to individual users. The legal basis for this is GDPR’s Art. 6 (1) lit. f (legitimate interests). When you delete the app, this data can no longer be related to you.


7. Your rights

In accordance with GDPR’s Art. 13 (2) lit. b, we draw your attention to your right to request the following: information on the processing of your personal data, its deletion, restriction on processing it or your objection to processing it.
Further, as per the Art. 77 of the GDPR, you have the right to lodge a complaint with the appropriate supervisory authorities against the processing of your data.
As soon as you delete the app, the data can no longer be particularly assigned to you and is made anonymous.
